2. Subject
This agreement governs the rights and obligations relating to the production and electronic delivery of the animated film made for a person or organisation, as defined in the quote sent to the buyer and numbered on the payment page. The quote is an annex to the agreement.
3. Price and payment
The price is the amount shown on the payment page, including all taxes. Payment is taken through the PayTR secure payment system. The seller operates under the tradesperson exemption in article 9 of the Turkish Income Tax Law. Tax-registered buyers document the payment with an expense voucher; where an invoice is needed, it is issued through an intermediary invoicing service and sent to the buyer's email address.
4. Performance and delivery
Once the material and approvals expected from the buyer arrive, the seller produces the film in the stages and times stated in the quote, submits drafts for the buyer's approval and makes requested changes within the revision rounds in the quote. The final film is delivered electronically (a download link or file). If delayed, the seller informs the buyer in writing; for a delay exceeding 30 days not caused by the buyer, the buyer may withdraw from the agreement and request a refund of the price paid.
5. Right of withdrawal
Since the film is prepared to the buyer's wishes and personal needs, and performance starts with the buyer's approval before the withdrawal period ends, there is no right of withdrawal under article 15 of the Distance Contracts Regulation. The buyer also confirms this separately on the payment page. For written cancellation before production starts, the full price is refunded within 14 days.
6. Usage rights
The delivered film is for the buyer's personal use or the corporate use stated in the quote. The seller does not publish the film or use it in promotion without the buyer's written permission. Unless the quote says otherwise, rights in components such as drawn characters and music remain with the seller.
7. Disputes
Within the monetary limits announced by the Turkish Ministry of Trade, the consumer arbitration board at the buyer's place of residence or where the transaction took place has jurisdiction; above those limits, the consumer courts do.
8. Entry into force
The buyer declares on the payment page that they have read and approved this agreement and the pre-information form. The agreement enters into force when payment is completed; a copy is sent to the buyer's email address.
